Lofty goal but so vague I can’t tell which way is up!

I remember something that sounded similar, a few years ago: It was calledAmericans Elect. They had awesome goals, and they even got Thomas Friedman to endorse them. Like Lawrence Lessig. (See I don’t say “Larry” because we aren’t really on a first name basis 🙂 The problem is that Americans Elect failed miserably, and there was even some buzz that it was some kind of a front for less savory operators who I would not have supported if I had known them. I honestly don’t remember the details anymore but it did make me less willing to jump in an support positive but vague sounding causes.

So I am not ready to jump in with both feet into Mayday.Us.

I came across this video by Armando Fox with his views of what went wrong with the Obamacare website, from a deep technical perspective. It’s part of a University of California at Berkley course on SAAS Software Engineering. It’s very very good!

I am reading a really cool book right now: Review & Outlook: Loose Lips on Syria – WSJ.com:

It’s always possible that all of this leaking about when, how and for how long the U.S. will attack Syria is an elaborate head-fake, like Patton’s ghost army on the eve of D-Day, poised for the assault on Calais. But based on this Administration’s past behavior, such as the leaked bin Laden raid details, chances are most of this really is the war plan.

A fascinating although quite long article by Michael Lewis in Vanity Fair. Michael Lewis is an amazing non-fiction writer, best known to me for Moneyball (about baseball) and Liars Poker (about Wall Street.)

I feel really bad for President Obama and I am still a big fan. But. As we all know now, this is a total disaster, on a lot of levels. For first hand experience, I tried to create an account on Healthcare.gov about the middle of October. After several tries I managed to do it. Yesterday I tried to log into the site to see how things were going, and after several tries and I managed to log in. But I didn’t get too far before I got a 404 error.

Those of us who have worked on, or seen close up how a complex “web site” is built have a feeling of how complicated this is. And coupled with other factors and complications (like politics and buareaucratic ineptitude) we can’t say this is not a movie...

Pretty amazing that the govt is actually placing all the code for healthcare.gov on github for all of us to inspect. There’s only one commit, and it’s 3 months old. Also there’s a reasonable amount of developer information available.

Somehow I suspect that it is not all there or how fast it will be updated, but still whatever’s there is a big step forward from the SOP of the past!

I have great sympathy for the team(s) that put up that web site, back end and other support infrastructure for this site. And in the best of possible conditions there will be hiccups in deploying such a complex system. Add to that that at 8:00am today everyone on earth knew that the site was up and that they could start playing with it, and you are facing a real challenge. I was a volunteer for the Democratic Committee in Arlington Mass. They have an impressive operation, just like what you’ve heard. For example, the systems they used to deploy us volunteers.

I am looking forward to watching the Presidential debates tonight. But for all the wrong reasons.

I believe I know pretty clearly what each side’s positions are and what they points will be. So, like when I watch a car race (which is rarely) secretly I have to admit that I will enjoy the suspense of seeing the big crash: the screwup, mistake or unscripted moment.

Whenever I hear, “We have the best health care in the world”, I think of stories like this. It is a travesty that in a wealthy country like the USA, there are 48 million Americans uninsured. An interesting question, and an expert answer from a friend of mine. If you are interested in elections and voting and how they can and cannot be bought, you might find this intriguing. By the way, this scheme would never work in the US as we have many mechanisms that would prevent that, but these might apply in other countries that are not as sophisticated.

Scenario:

Say a bad guy made an offer secretly to the population that he would give each voter $100 for a vote cast for himself. Say they are using optical scan ballots. Say that cell phone cameras are easily snuck into the polling booth.

If you were the bad guy, what proof would you ask for so that people couldn’t trick you and colle...

Lucky Me! After tortured litigation and lots of legal fees (not mine, of course), I am receiving a check for $0.47 as my payout for the litigation between Hanson and Google.

What, never heard of Hanson? Well apparently the law suit was about Google doing something wrong in how the charged or paid for Google Adwords. Which I think I might have used a little some long time ago.

But really, how does it make sense to pay out 47 cents? I am sure the lawyers (for both sides) are laughing all the way to the bank!

Americans Elect got Tom Friedman to endorse their effort to get a third party presidential ballot in November. He wrote about it and convinced me too that it was a good idea. A month or two ago I started having misgivings and now, it seems like things are really turning sour for Americans Elect.

There is always a good deal of controversy surrounding elections and in particular, whether an election is ‘fair’ or not. As I have been working on a project with the Open Source Digital Voting FoundationI’ve been exposed to this from time to time.

Typical of a nerd like me, I focus more on the design and technical elements than the data that it is trying to show. This article gives a fascinating perspective on the disconnect between what they teach in law school and what knowledge is required to actually be an effective lawyer. Some great facts from the article:

I am not dead set against software patents, although I’ve been on both sides of the issue.

I am the proud inventor listed on 3 or 4 patents. Some are more worthy in my opinion that others. I was also leading a development team that had to stand on its head to avoid conflicting with a patent that everyone agreed should never have issued, but we didn’t have the nerve or resources to contest.

So I was interested to see some behind the veil of “Intellectual Ventures”, Nathan Myhrvold’s IP/Patent company:

Andrew Appelis one of the best known academics studying and commenting on elections and computer science and technology related to elections. He wrote a really interesting report, “New Jersey Elections Coverup“, going into great detail about a specific incident during the June 2011 New Jersey primary election where the reported outcome of a particular race was demonstrated to be incorrect.

Mike Taibi writes in Rolling Stone about some fairly outrageous doings between Washington D.C. and Wall Street during the various ‘bailouts‘: “Christy is the wife of John Mack, the chairman of Morgan Stanley. Susan is the widow of Peter Karches, a close friend of the Macks who served as president of Morgan Stanley’s investment-banking division. Neither woman appears to have any serious history in business, apart from a few philanthropic experiences. A theme that I have followed in this blog is the question of whether it’s a good idea to require a picture ID of some kind before permitting a citizen to vote. In another article in the New York Times called “Republican Legislators Push to TIghten Voting Rules”, Governor Nikki Haley of South Carolina had this quote:

Every time there’s an election it seems like someone brings up the odd fact that you are not asked for ID here in Massachusetts before being allowed to cast your ballot. It seems to me that this is especially surprising to people from other countries. Here’s a good article that explores some of the reasons and arguments for and against requiring identification at the polling place.

Fareed Zakaria’s GPS program on Sundays for me is now easily the best. He has interesting, thoughtful segments that don’t fall into that boring greyness that the rest of TV news has become. Nowadays, I only tune in to TV news for the visuals.

I’ve seen several interviews with Scott Walker, the Governor of Wisconsin, about his efforts to ‘balance the budget’. I put that in scare quotes because there’s a good case to be made that his agenda is different or at least well beyond that.

He’s very articulate about his position, and quite convincing. None of the interviewers had anything to add to the debate other than, “gee aren’t you union busting?” and “gee, how come isn’t it good enough that the unions have agreed to the financial concessions?” And the Governor has very good answers to each of the ob...

Interesting commentary on a new book by Harvey Silvergate called “Three Felonies a Day”. The article also touches on the notion that “Under the English common law that we inherited, a crime requires intent.”, saying: “Sometimes legislators know when they make false distinctions based on technology. An “anti-cyberbullying” proposal is making its way through Congress, prompted by the tragic case of a 13-year-old girl driven to suicide by the mother of a neighbor posing as a teenage boy and posting abusive messages on MySpace. The law would prohibit using the Internet to “coerce, intimidate, harass, or cause substantial emotional distress to a person.” Imagine a law that tried to apply this control of speech to letters, editorials or lobbying” (from Wall Street Journal)

Sunlight Foundation is a very cool organization that I’ve been close to. They are involved with many efforts to further government transparency and accountability, often using technology, but not only. Recently they ran their second competition looking for interesting and useful applications and tools to be built using or leveraging data published by government.

It’s a clever model: offer $10,000 or so to a winner who creates and submits the most interesting entry. Give applicants encouragement, publicity and assistance. I have to believe that this creates a groundswell of energy and hacking that furthers the foundations goals and uses the prize money in a highly leveraged way.

It strikes me that the way speakers are being shouted down at these (now) famous town hall meetings on health care reform is a form on human ‘denial of service’ attack. They are taking advantage of a permitted communication (asking a question) to totally shut down a service (the speaker) by overwhelming the service with communications, thereby denying service to others in the audience.

By doing it ‘loudly’ they end up denying service further by drowning out legitimate requests, by noise and intimidation.

There are people in our government who are strongly pushing for more openness and who are very focused on delivering better, more modern, service to citizens. So now that I made a point about my skepticism about whatever politicians say about the economy (see "Who Can I believe about the economy") here’s some more.One pal told me, nicely, that my appreciation for Paul Krugman was misguided, that Krugman’s a socialist (whatever that means) and that Krugman’s way off base and extremely partisan. Whoops. Now I am even more confused.

The problems in our economy right now are real, I believe. Tons of people have lost jobs, and my investment accounts also prove it. I guess there’s no debate about that. But the question is, what to do about it. My observations:

Politicians on both sides are equally passionate yet totally contradict each other about what they claim to be ‘facts’.

The most glaring one is, for me, “are tax breaks stimulative or is government spending stimulative?

I mean this is a case where apparently intelligent adults are calling the sky red and the grass blue.

I’ve been discovering the mass of information that is created by the government and is very slowly making its way online. I will be posting my discoveries from time to time. The process of making public information available online seems to go something like this:

Law requires that information be collected and disseminated

People submit forms etc recording such information

Others then scan or otherwise process this information and puts it into a database “silo”

The database is put online onto a “silo” web site

Other NGOs or agencies then somehow get that data (often by scraping the web sites) and make it API accessible

It seems like there may be one or more years between each of these ...

I’ve gotten interested in what is going on in the public sector, in particular in the world of non profits. Someone asked said to me the other day, ‘you’re really political aren’t you?’ I don’t consider myself very political at all, never have been. One a scale of 1 to 10, I’d rate myself a 3. So in a way I have surprised myself in the last 12 months.

I have to say that when I read it, the thought expressed in the quote above really resonated.

There’s been some back and forth silliness about whether Barack Obama can keep his Blackberry. All the pundits said “no way” but I thought, geez, the guy is President (did you hear?) all he has to do is say: ‘make it so’: “On Monday, a government agency that the Obama administration — but that is probably the National Security Agency — added to a standard blackberry a super-encryption package…. and Obama WILL be able to use it … still for routine and personal messages.” (from Marc Ambinder inAtlantic)

Chris and I, this morning, looking forward to a great day. We’ve waited and worked for this. And now the day has come.

I came across this ad in the New York Times magazine. I should say, I was riveted by this ad. Is this a real building? Is it built yet? You have to take a look at some of the images on (what I think is) their main site. But really the ad in the magazine is the one that is still the most impressive.

On Tuesday, Chris and I volunteered for Barack Obama. I got a very interesting perspective on the election process in the US, and to tell you the truth, it was impressive. I read the New York Times, and magazines like The Atlantic and The New Yorker, and web sites like Salon. Each of these, IMO are relatively thoughtful and interesting and a good way to keep up with what’s going on. And I tend to agree with them often. I guess my liberal bias matches their liberal bias. I feel like I am not hearing ‘the other side’.

What are the counterparts to for example The Atlantic or Salon for the right? Whatever commentary I come across that leans more conservative tends to be shrill, partisan and impossible to take seriously. I’ve been looking at the Wall Street Journal’s political coverage which qualifies.

But can someone point me to the conservative equivalent of The Atlantic or New Yorker or Salon?

Ok this is a bit irreverent. There’s been a spat relating to the note that Barack Obama wrote and left in the stones of the Western Wall (the “wailing wall”). This tradition goes way back.

The spat is about the fact that someone pulled it out and photographed it and it’s been all over the papers.

I agree that this was an awful invasion of privacy and inappropriate, which is why I resist the strong temptation of putting a copy of the letter.

But how my weird mind works: the letter was a very nice generous and humble statement. But I found myself looking to the end to see how Mr. Obama ‘signed’ the letter. Well it was unsigned, which struck me for some reason as funny.

I mean I guess the intended recipient of the letter would know who wrote it. I guess that’s the difference between a letter and a prayer.

A lot has been written about electronic voting machines and their vulnerabilities. There is indeed something very primitive about the way we vote today, with markers on sheets of cardboards. You’ve got to believe that we will not always be using physical means, and that sooner or later it will be computerized.

Apparently the US State Department has a team of bloggers who get into discussions on boards and blogs around the world, taking an interesting alternative approach to the usual formal, high level diplomacy:

Regular readers of this blog know about AllOfMp3.com, a Russian music site that sells music of all kinds for a ridiculously low price. It’s kind of like the iTunes or EMusic store, but at a fraction of the price. Every so often there is news that they are about to be shut down because they are fraudulently selling copyrighted music. They say that what they are doing is strictly legal by Russian law.

I don’t know who is right. But as they say, “If it seems too good to be true, then it probably isn’t true…”

Anyway, from time to time their ability to be paid via credit card (like Visa etc.) is disabled....

You know that I follow what’s going on in Venezuela. A bit of a debate is developing regarding Microsoft’s recent patent for (and here’s where the editorializing starts) "RSS". It’s only a slightly interesting question which is why I won’t pursue it, save to say that patents are very technical and narrow so it’s easy to jump to the wrong conclusion about them when reading them only superficially.

At any rate if there’s any beef to be had, IMHO, it’s with the Patent Law and the Patent Office, not with Microsoft.

I don’t know if you followed the spat a few months ago. This book, “A million little pieces” by James Frey was chosen by Ms. “O” (Oprah) for her book club. A lot of fanfare, a lot of press. It’s a memoir about one man’s experiences as a totally out of control addict, then joining a rehab program and getting on the road to recovery.

The problem is / was that after Oprah made all this fuss about James Frey, it turned out that certain details of the book were fictionalized. It was not exactly clear whether 10%, 20% or what were not from his real life experience...

I was probably the last one to hear about AllofMp3.com. It’s this massive, well organized and apparently solid Mp3 download site. Music is not free, but extremely cheap. It’s apparently hosted in Russia or somewhere else.

The question is of course, “is it legal” and “is it ethical”? Friends of mine who’ve known about it for years (claim to) never use it. I have to say it gives me pause to download the whole “Tapestry” Album (Carole King, from the Jurasic Period) for something like $1.50. Ridonculous.

I just finished reading an excellent book called Confessions of an Econmonic Hit Man. Quite amazing really. Tells about the machinations of american foreign aid, and how all foreign aid is not as benevolent as you might think. Also kind of hints at why there are so many Texas oil men and huge construction contractors represented in the government. A fascinating read. Recommended.

I recently had occasion to learn all about a really cool MMORPG (“massively multi player online role playing game”) called Gaia Online.

Yes, I am not in its demographic, but it was fascinating to learn about how the world of gaming has developed a whole economic model in the form of “XP” or “Experience Points”. I just came off listening to Dan Bricklin’s first podcast, an interview with Linda Hamel of the Commonwealth of Massachusetts about patents, intellectual property and open source. Quite interesting info. I am looking forward to listening to the other ones.

Doc comments with grudging admirationthat IBM has decided to give away some parts of their much vaunted patent portfolio. One interesting tidbit is that in addition to being responsible for the most patents granted annually, IBM is also the leader in the most patents allowed to expire annually.

Why? Because keeping all those patents current is very costly, and if there is no economic benefit to having those patents, that’s a lot of money down the shute.

So maybe some clever strategist/marketer (difference?) probably realized that the PR value of open sourcing these worthless patents might actually be the most valuable of all!

The demos at this year’s DEMO are quite good. One interesting thing I noticed is that there are several productsconnected to keeping companies out of legal trouble due to problematic internal and external emails, or to help get them out of trouble if they get into it. In several demos we were treated to examples based on the “Enron internal emails.” The first two times I thought I was seeing a coincidental picking of the same humor by two seperate companies.

But when it came up again, I went searching, and wouldn’t you know that during the discovery process of the whole Enron ...

Here are two practical examples of how mainstream media (“MSM”) sometimes overlooks really interesting or engaging stories which are well covered online (and I don’t mean just blogs.) Have you seen these?

I never was a fan of Tommy Thomson – what a name! Ok, I am adjusting to the new reality of the lost election. The amount of coverage in the blogs I frequent is huge so I won’t add to the noise, except to offer a few graphics that I found interesting.

I’m a huge fan of Talking Points Memo, Josh Marshall’s blog. In fact it’s my exhibit #1 for people who ask me for a good blog to read (assuming they are “liberal.” If they are not I point them to Instapundit.) Anyway just a few words about Josh Marshall’s complaint about how the spinmeisters positioned Kerry’s comment about Cheney’s daughter the other night. They called it “A crass, below-the-belt political strategy to attach the president’s daughter.”

Well, my reaction was the same as Mr. Marshall’s – how can they call what Kerry said an attack? You can call it a lot of thin...

This puzzled me. Once we released the BlogBridgesource code under the LGPL, it was out in the open, and published to the world. Had we forfeited the right to change the license? The answer depends on who owns and holds the Copyright to the code. As it is, all the code was either personally written by me (90%) or written by others who have agreed to transfer ownership to me. In other words, I hold a clear copyright to all the code, and that is the key. This makes it legitimate and legal to reissue the same source code under a new license.

What existed before (i.e. everything up to 0.5.3) under LGPLwill ...

I’ve done a little research about what the Open Source really means, legally, when it comes to BlogBridge. I wrote about this question a few months ago, and now, having consulted with people who know, here’s an update. First of all, start with the goals.

BlogBridge should be available, in source code form and executable form to everyone who wants to look at it and use it. It should be a bona fida open source project. Reasoning: We will be able to recruit others to help us build it; It is a significant differentiator among the other blog readers out there; And we can legitimately use services such as Source Forge to manage the project and its source code. As I continue to make rapid progress on BlogBridge, now with a significant amount of help, I am asking myself some tricky questions about licensing, which I thought I’d try out here. (By the way, BlogBridge is the blog reader that I’ve been working on and which is soon going to be available in beta form.)

Several people asked me about what the security situation in Spain felt like. I have to admit it did give me pause to be going to Spain little more than a month after the terrorist attack on the trains in Madrid. In fact our travel plans included several long train rides. I checked with friends who live in Spain, and also looked at the various State Department notices, and all in all decided that the risk wouldn’t be major. I did expect to see a major security presence — you know, soldiers with machine guns in the airports, etc. But otherwise I wasn’t especially worried, but curious what we’d find. One of the reason that society needs people to transact with each other using real identities, maybe, is that in the end, virtual digital persona can’t own and transfer ownership. I can’t buy or sell or trade with a virtual digital persona. Corporations in fact are virtual people in some sense, and indeed they are legally regulated much like people are. Maybe in the future the law will expand to allow my virtual identity to own and transact separately from me, with it’s own ‘social security number’, the ability to have a checking account, to own property and generate income. But for that to happen it would seem to me that the law would have to catch up and regulate digital personas as a third actor along with natural people and corporate-like entities.

Feeling like a Red Sox Fan. Kerry seems to have won the Democratic nomination, and convincingly. I’m rooting for him in the Big Show in November, right along many others, but, why do I feel like a Red Sox Fan?

The two Howards: Dean and Stern. Everyone is wringing their hands about the way Howard Dean acted out on the night of the Iowa Caucuses. I heard well known pundits talk about ‘the defining moment of Dean’s campaign.’ What a bunch of nonsense. This was a non-event, a crazy moment at the end of a long day with a huge crowd of revved up supporters. Well, is it Dr. Dean or Governor Dean? It’s funny to me when people try to build up Howard Dean’s stature by using one or the other title, depending I guess on what the speaker thinks sounds more impressive. I’d say given the job he’s applying for, the only relevant qualification is Governor Howard Dean.
